Sale Listing Agreement

This is a Non- Exclusive Agency Agreement, between SUMMA SAMUI CO. Ltd. Addressed at House No. 143/13 Village No.4 Maret Sub-district, Koh Samui District, Suratthani Province , Represented by Ivan Martinez-Colomer Garcia. ID: 24359096A whit Spanish nationality. (The Broker), and the owner of the Property (The Owner).

The Owner warrants:

  1. The Owner has the legal rights or has the full authority to sell the Property and the Owner assigns the Broker to contact and source a prospective buyer. The owner warrants that the information provided to the broker on the property and its condition is complete, accurate and that all such matters have been fully disclosed.
  2. The owner grants the right to the broker to advertise and promote the property whether through internet messages, sales boards, social media, direct marketing, printed materials, or any other suitable method of finding a buyer.
  3. The owner accepts that the broker can enter into co-brokerage agreements.
  4. In the event that the sale/purchase of the property is finalized, the owner shall pay to SUMMA SAMUY CO. LTD , a commission (written at the bottom of the contract)of the sales price of the property. The commission will be paid by Summa Samui Co. Ltd at the time the sale becomes effective and complete, and will be made by bank check or cash, made out to this company. This amount will be deducted from the total amount of the transaction, so the purchasing party will issue the final payment of the operation in separate parts. One will be in the name of the selling party with the part that corresponds to it, and on the other hand the payment of the commission.

      If buyer and seller agree to some type of deferred payment, the sales work by the agency is considered done, so the commission will not be subject to the times agreed between buyer and seller. The commission will become effective at the time of the transfer of possession of the property

  1. This Contract is written in English, the preferred language, understood and accepted by the parties. Either party shall have the right to terminate the Agreement upon 15 day’s notice to the other party.
